Sacramento, California Military Divorce Lawyer
Military divorces involve a broad range of issues that differ from civilian divorces. If you are a member of the military or a spouse facing divorce, you should not assume that an attorney experienced in handling civilian divorces will also be experienced handling military divorce.
At the law offices of Hugh O. Allen, we have handled family law in Sacramento, California for over 30 years. More importantly, we have handled military divorces for that time as well.
Attorney Hugh O. Allen is a patriot and was a member of the Navy Active Reserve and Retired Reserve for 43 years. Since the Civil War, every generation of his family has served with the US military. He retired on September 10th, 2001, the day before the World Trade Center attacks.
Military Retirement Pensions
Military pensions are considered to be community property, which means that both spouses are entitled to a share in the pension regardless of which spouse served. However, the method of division and the amount received by the non-military spouse will depend upon the length of the marriage.
Residency Issues and Overseas / Out-of-State Deployment
Before proceeding with a military divorce, it is first necessary to ask basic questions about jurisdiction: in which state and county court system should the divorce take place? This can become confusing if the military member is stationed in a base outside of California, whether in another country or domestically.
The same is true for soldiers or sailors who have established residencies in other states but who are stationed here. If you have been in California for six months or more, then you have established residency in California and you will have to handle your divorce under California laws in California courts.
